Why Does Service of Process Fail? Common Reasons Explained

Delivering a legal document sounds simple, but service of process fails more often than most people expect — and when it does, it can delay a case by weeks or months. Understanding the common causes can help you avoid them.

An outdated or incorrect address. This is the single most common reason an attempt fails. People move, businesses relocate, and the address on file with a court or a state registered-agent database isn’t always current.

The recipient is actively avoiding service. Some defendants know a process server is looking for them and change their routine accordingly. This is where scheduling attempts at varied times — mornings, evenings, weekends — and skip tracing tend to make the difference.

Using the wrong method for the recipient. Serving an individual, a corporation, and a government entity often involve different rules. Serving a company’s front desk instead of its registered agent, for example, can invalidate service entirely.

Missing a jurisdiction’s specific requirements. Some states or countries require a certain number of attempts before alternative service is allowed, require service during specific hours, or require a particular form of documentation. Overlooking these details is an easy way for service to be challenged later.

Incomplete or incorrect documents. If the papers handed to a process server are missing a page, unsigned where a signature is required, or don’t match the case caption, service can be deemed improper even if delivery itself went smoothly.

The common thread across all of these is preparation — verifying the address, confirming the correct service method for the type of recipient, and understanding the specific jurisdiction’s rules before the first attempt is made.
