Taking Evidence Abroad

Obtaining testimony or documents from a witness in another country follows its own set of rules. Under the Hague Evidence Convention, and through letters of request for non-member countries, we help counsel request evidence through the channels the destination country accepts.

Getting testimony or documents from a witness in another country is governed by the 1970 Hague Evidence Convention for member countries, and by letters rogatory for the rest. Each country sets its own limits, and some restrict depositions of their residents or refuse broad pretrial document requests.

Can we just hold a deposition abroad like we would in the U.S.?

Not always. Some countries limit or prohibit depositions of their residents for foreign cases, or require them to take place at a U.S. embassy or consulate. We check the country's rules before anything is scheduled.

Will a foreign country produce documents for U.S. pretrial discovery?

Many countries have declared under the Hague Evidence Convention that they won't execute requests for broad pretrial discovery of documents. Narrow, specific requests have a much better chance of succeeding.
